At Color Up, we have always valued truth over marketing. In the current regulatory landscape, a "Full Spectrum" product under the new 0.4 mg THC container cap would contain such a negligible amount of THC—even in a one-ounce container—that it would offer no physiological "entourage effect". To continue marketing a product as "Full Spectrum" when it has been stripped of virtually all THC would be, in our view, out of integrity. We refuse to sell a label that doesn't deliver on its promise.

Why We Support the 0.4 mg Limit
With the data we've gathered over the last 11 years, we fully support the ruling to dramatically lower allowable THC content in hemp products. This new limit closes the loopholes that allowed for the creation of intoxicating products under the guise of hemp. We pioneered cannabis wellness by growing our own plants long before it was legal; we have seen firsthand the supportive benefits of the Hemp plant. While both CB1 and CB2 receptors exist throughout the skin, their distribution is highly specialized.

Hemp VS Marijuana

Some of CBD's legality lies in whether the CBD is derived from hemp or marijuana. CBD is found in both hemp and marijuana plants among the three different varieties; Cannabis indica, Cannabis sativa, and Cannabis ruderalis. Hemp and marijuana plants are both cannabis plants, but the difference is determined by the percentage of THC contained in the cannabis plant. The simplest way to look at it is:

• Cannabis containing more than 0.3% THC is considered marijuana
• Cannabis containing 0.3% or less THC is classified as hemp

The CBD market continues to operate under a tangled web of regulations. While the 2018 Farm Bill legalized hemp-derived CBD with under 0.3% THC, state-level interpretations vary dramatically. This patchwork creates real challenges for businesses navigating compliance across borders.

2. New Proposals in the 2025 Farm Bill

The evolving 2025 Farm Bill proposes significant changes, such as redefining hemp by total THC (including THCA), tightening THC limits, and expanded testing and labeling requirements. These updates aim to enhance consumer safety and market transparency.

3. State-Level Crackdowns on Delta-8 & Intoxicating Hemp Compounds

Across the country — particularly in Southern states — there's growing enforcement against intoxicating hemp derivatives like Delta-8 and Delta-10 THC. This reflects a shifting regulatory focus on limiting such products despite federal legal limits. Color Up does not sell Delta-8 or any synthetic intoxicating hemp compounds.

4. Legal Risks: RICO Enforcement & Mislabeling Liability

A key 2025 Supreme Court ruling confirmed that economic damages from mislabeling (e.g., stated "THC-free" but tests positive) now fall under civil RICO protections. This significantly raises liability risk across the CBD industry, emphasizing the need for airtight transparency in labeling — which is why every Color Up product ships with a batch-specific COA.
