CBD is federally legal in the United States and has been since 2018. Most states will allow the possession of hemp-derived CBD since it contains less than 0.3% THC. If you’re traveling to a state with strict marijuana restrictions, check the state laws before carrying CBD and make sure your CBD products are THC-free.

Traveling Within the United States with CBD Oil

The TSA website states that “TSA’s screening procedures are focused on security and are designed to detect potential threats to aviation and passengers. Accordingly, TSA security officers do not search for marijuana or other illegal drugs, but if any illegal substance is discovered during security screening, TSA will refer the matter to a law enforcement officer.” So if you are traveling to another state within the United States, you shouldn’t have to wonder “can you take CBD oil on a plane” as long as it was purchased from a reputable brand that guarantees the CBD oil contains less than 0.3% THC. 

Flying Outside the United States with CBD Oil

Rules surrounding CBD and cannabis can be very different in other countries. CBD is prohibited in some countries still, even if it contains less than 0.3% THC, and the punishment for being caught with CBD could vary greatly. For example, as of 2022, all cannabis products are illegal in Russia and could result in prison time. Additionally, in some countries, CBD is legal, but the allowable amount of THC may be lower. So, be sure to do your research and know if there are risks involved in traveling to another country with CBD. 

How Do You Know If the CBD Oil is Reputable?

When flying with CBD oil, especially out of the United States, you will want to feel confident that the CBD you have contains the amounts of CBD and THC that it claims.
